Capitalized terms used herein without prior definition shall have the meanings set forth below:
“Client” refers to a natural person, of legal age, acting for his or her personal needs and having full legal capacity to enter into these terms and conditions.
“Terms and Conditions of Sale of the Reserved Rate” means the specific conditions of each booking made by the Customer.
“Booking Confirmation” means the document summarizing the details of the reservation made by the Customer, sent by the Website or the Riad to the Customer.
“Booking Request” means any room reservation request made by the Customer.
“Riad” refers to the Riad La perle d’Orane, operated by RAK CARM (in the process of being created) with a capital of 50 000 DHS registered under the number of the Commercial Registry of Marrakech under the number …….. whose head office is located at 20 rue el Gza, derb Jamaa in Marrakech (40 000). “Service” refers to any room reservation service made by the Customer on the Riad website.
“Riad Website” refers to the website dedicated to the Riad accessible at the following address www.laperledorane.com
Article 1 – Scope of application
These General Terms and Conditions of Sale apply, without restriction or reservation, to any purchase of the Riad’s room reservation services and ancillary services (‘the Services’) offered by the Riad to consumers and non-professional customers (‘Customers or the Customer’) on the Riad website.
The main characteristics of the Services are presented on the Riad website. The Client is required to be aware of this before any booking. The choice and purchase of a Service is the sole responsibility of the Customer.
The Customer declares :
- Have full legal capacity to enter into commitments under these General Terms and Conditions of Sale.
- Book rooms and ancillary services for personal use.
- Be able to save and print the present Terms and Conditions.
These conditions apply to the exclusion of all other conditions, in particular those applicable to other sales channels for the Services.
Article 2 – Prices
Prices are indicated in Euros and/or Moroccan Dirhams including all taxes (VAT and other taxes applicable on the day of the order), unless otherwise specified and excluding tourist tax fees.
All orders, whatever their origin, are payable in euros and/or Moroccan dirhams.
The Riad reserves the right to modify its prices at any time, but the product will be invoiced on the basis of the tariff in force at the time of validation of the order and subject to availability.
The price paid includes the rental of one or more rooms in the Riad for the period defined at the time of purchase.
Rates do not include tourist tax, payable directly to the Riad.
The customer undertakes to pay these various taxes to the Riad without any dispute.
The payment requested from the Customer corresponds to the total amount of the purchase, excluding this Tax.
Unless otherwise stated on the Site, additional services (massage, use of the Hamam, lunch or dinner, etc.) are not included in the price except for breakfast.
Article 3 – Orders

The Client selects on the website the services he wishes to book, according to the following terms:
- Selection of ancillary services if required
- Verification and validation of the details of the reservation, the total amount of the reservation, the conditions of the rate
- Indication of his contact details
- Entering your bank card details in the event of a guarantee or prepayment
- Consultation and acceptance of the general terms and conditions of sale and the conditions of the selected rate prior to the validation of your reservation
- Validation of your reservation
The Client acknowledges that he or she has read the nature, destination and booking methods of the Services offered by the Riad and that he or she has requested and obtained the information necessary to make his or her reservation in full knowledge of the facts. He is solely responsible for his choice of services and their adequacy to his needs, so that the Riad’s liability cannot be sought in this regard. The Client undertakes to complete the information requested on the booking request and attests to the veracity and accuracy of the information provided. The contractual information is presented in French and is confirmed at the latest at the time of validation of the booking by the Client.
The sale of Services will only be considered final after the confirmation of the acceptance of the reservation by the Riad has been sent to the Customer by e-mail and after the full price has been collected by the Customer. Any booking made on the Riad’s website constitutes the formation of a contract concluded at a distance between the Client and the Riad. The Riad reserves the right to cancel or refuse any reservation by a Customer with whom there is a dispute relating to the payment of a previous reservation. Each booking is nominative and cannot be transferred to a third party under any circumstances.
Cancellation of a reservation D+31:
In the event of cancellation of the reservation at the Refundable rate by the Customer after its acceptance by Le Riad more than 30 days before the scheduled date of stay, for any reason whatsoever, the corresponding amount (100% of the total amount) will be refunded in full.
Cancellation / Modification of a reservation D-30 :
In the event of cancellation or modification of the reservation by the Guest less than 30 days before the scheduled date of stay, for any reason whatsoever, a sum corresponding to 100% of the total prepaid amount will be automatically acquired by the Riad and invoiced to the Guest. The same will apply in the event of a no-show by the Client on the scheduled date of arrival.
Article 4 – Validation of the order
Any order appearing on the www.laperledorane.com website implies that the Customer adheres to these General Terms and Conditions of Sale. Any order confirmation entails the Client’s full and complete acceptance of these general terms and conditions of sale, without exception or reservation.
All the data provided and the recorded confirmation will be deemed proof of the transaction.
The Client declares that he or she is fully aware of this.
The order confirmation will be deemed to be the signature and acceptance of the operations carried out.
A summary of the order information and these Terms and Conditions will be sent to the order confirmation email address.
Article 5 – Payment
The fact of validating the order implies for the Client the obligation to pay the price indicated.
Payment for your purchases is made by credit card using the system offered by the site at the time of purchase
The amount debited from the card is:
- 50% of the booking amount
- The 50% due will be paid directly upon arrival at check-in
Article 6 – Availability
In the event of the unavailability of a room after placing your order, the Customer will be informed by email within 48 hours and a replacement solution (upgrade) will be proposed.
Article 7 – Service
The Services booked by the Customer, which include the reservation of Riad rooms and ancillary services, will be provided in accordance with the following procedures, under the conditions set out in these General Terms and Conditions of Sale, which the Customer has read and accepted when booking on the Riad website.
Upon arrival, the Client will be asked to present his/her identity document in order to ensure his/her obligation to complete a Police Form.
The Riad is a completely non-smoking area (except on the terrace). The customer will be held liable for direct and/or indirect, consequential damages resulting from the act of smoking in Le Riad. He will therefore be liable for the full amount of the costs of cleaning and restoring the damaged element or space to its original state.
The Client’s personal belongings left in the Riad’s room or in the public areas of the Riad are the sole responsibility of the Client. The Riad cannot be held responsible for loss, theft, deterioration or damage caused to said effects.
The customer accepts and undertakes to use the room with due diligence. Also, any behaviour contrary to good morals and public order will lead Le Riad to ask the Customer to leave the establishment without any compensation and or without any refund if a payment has already been made. In the event that no payment has yet been made, the customer must pay the price of the nights consumed before leaving the establishment. The Customer will be held liable for all direct and/or indirect, consequential damage caused by him/her, observed in the room booked or that he/she may cause within the Riad. Consequently, it undertakes to compensate Le Riad up to the amount of said damages, without prejudice to any damages that may be due, procedural and legal fees incurred by Le Riad.
Free WIFI access for guests to connect to the internet is offered according to the Riad’s current policy.
Unless expressly stated otherwise, the Room will be made available to the Client on the day of arrival at 3 pm and the Client will leave the room on the day of departure at 11 am. Otherwise, an additional night will be invoiced to the Customer. The Client must check their departure date. In case of early departure, a fee equivalent to one night will be charged, unless the Customer has notified Le Riad at least 24 hours before departure.
Breakfast can be served between 8:30 am and 12 pm.
The Service Provider undertakes to make its best efforts to provide the Services booked by the Client, within the framework of an obligation of means.
The Client will have a period of 8 days from the date of departure from the Riad to issue, in writing, reservations or complaints regarding the provision of the Services, with all the related supporting documents, to the Riad.
No claim can be validly accepted in the event of non-compliance with these formalities and deadlines by the Client.
In the absence of reservations or complaints expressly expressed within this period by the Client upon receipt of the Services, they will be deemed to be in conformity with the booking, in quantity and quality.
In the event of eviction:
In the event of an exceptional event, force majeure or the impossibility of making the reserved room available to the Customer, the Riad reserves the possibility of having the Customer accommodated in whole or in part in a Riad of equivalent category, for services of the same nature and subject to the Customer’s prior agreement.
Article 8 – Place of delivery of the service.
Rooms are offered at Riad la perle d’Orane, N°20 rue el Gza, derb Jamaa in Marrakech (40 000).
Article 9 – Warranty
The Service Provider guarantees, in accordance with the legal provisions and without additional payment, the Client, against any lack of conformity or hidden defect, resulting from a failure to perform the Services booked and actually paid for under the conditions and according to the terms and conditions defined in these General Terms and Conditions of Sale.
The Services provided through the Riad’s website comply with the regulations in force in Morocco. The Riad cannot be held liable in the event of non-compliance with the legislation of the country in which the Services are provided, which it is the responsibility of the Client, who is solely responsible for the choice of the Services requested, to verify.
Article 10 – Liability
The rooms offered and, in the case of a rental of the entire Riad, comply with the Moroccan legislation in force The Riad cannot be held liable in the event of non-compliance with the legislation of the country of origin of its customers. Only Moroccan legislation is authentic. In addition, the Riad cannot be held responsible for damage resulting from the misuse of a room or the common areas provided.
Finally, the Riad cannot be held liable for any inconvenience or damage inherent in the use of the Internet, in particular a break in service, an external intrusion or the presence of computer viruses.
Guests undertake to return the Room and the Riad in the working condition in which they found it upon arrival. All the objects, accessories, linen, equipment, decoration… present in the room and/or in the common areas upon the arrival of the Guests remain the exclusive property of the Riad. Any object that disappears in the Room occupied by the Guests or in the common areas of the Riad will be automatically charged at the purchase price. Unless the Client returns the missing goods, he unconditionally accepts that the amount will be debited from his bank card.
Article 11 – Applicable law in the event of disputes
The language of this contract is French, one of the three official languages of Morocco. These terms and conditions of sale are subject to Moroccan law. In the event of a dispute, the Moroccan courts will be the only ones competent.
Article 12 – Intellectual property
All elements of the www.laperledorane.com/ site are and remain the intellectual and exclusive property of the Riad. No one is authorised to reproduce, exploit, rebroadcast, or use for any reason whatsoever, even partially, elements of the site, whether software, visual or sound Any simple or hypertext link is strictly forbidden without the express written consent of the Riad.
Article 13 – Personal data
The Riad reserves the right to collect personal information and personal data about you. It is necessary to manage your order, as well as to improve the services and information we send you.
It may also be passed on to companies that contribute to these relationships, such as those in charge of performing services and orders for their management, execution, processing and payment.
This information and data is also kept for security purposes, in order to comply with legal and regulatory obligations.
Article 14 – Pre-contractual information – Acceptance by the Client
The Client acknowledges that he or she has been informed, prior to the placing of his or her booking and the conclusion of the contract, in a legible and comprehensible manner, of these General Terms and Conditions of Sale, in particular the following information:
- The essential characteristics of the Services, taking into account the communication medium used and the Service concerned;
- The price of the Services and related costs;
- In the absence of immediate performance of the contract, the date or period within which the Service Provider undertakes to provide the Services booked;
- Information relating to the identity of the Service Provider, its postal, telephone and electronic contact details, and its activities, if it is not apparent from the context,
- Information relating to legal and contractual guarantees and their implementation;
- The functionalities of the digital content and, where applicable, its interoperability;
- The possibility of resorting to conventional mediation in the event of a dispute;
- Information on important contractual conditions.
- Accepted payment methods.
The fact that a natural (or legal) person makes a reservation on the Riad website implies full and complete acceptance of these General Terms and Conditions of Sale and the obligation to pay for the Services ordered, which is expressly acknowledged by the Customer, who waives, in particular, the right to invoke any contradictory document, which would be unenforceable against the Service Provider.
